By submitting user-generated content, including, but not limited to, photography, videography, essays, editorial comments, recipes, crafts or that includes your name, city and state of residence, biographical information, voice, image and/or likeness, (collectively, “The Materials”), you (“User”) grant Martha Stewart Living Omnimedia, Inc. and MSLO Productions  (collectively, “MSLO”) the royalty-free right to use, not use, re-use, copy, publish, republish, broadcast, re-broadcast, in whole or in part, edit, modify, rearrange, create derivative works from and otherwise exploit The Materials based thereon or derived therefrom, in any manner, for any lawful purposes whatsoever, including but not limited to, appearing in any future issues of MSLO publications, on the internet,  on any social media site, and for use in any packaging, for advertising and promotional purposes in any medium (whether now or hereafter known) throughout the world, in perpetuity, without further permission, consideration, or payment, unless prohibited by law. The Materials submitted become the property of MSLO and will not be acknowledged or returned. MSLO has the right to remove or dispose of The Materials at its sole discretion. By submitting The Materials, User warrants and represents that (a) The Materials are 100 percent original and were created solely by User; (b) User has the express permission from any and all individuals other than User who are shown or described in The Materials; (c) User has the express permission from the parent(s) or legal guardian(s) of any individual who is shown or described in The Materials that are under the age of the majority in his/her state of jurisdiction at the time The Materials are submitted; (d) User waives all copyrights related to The Materials; and (e) MSLO’s usage as set forth above will not infringe or violate any right of any third party, including, without limitation, intellectual property, or the right of privacy and publicity.

a.   Restrictions:

The Materials must not contain content that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;

The Materials must not disparage MSLO or its image or any other person or party affiliated with MSLO;

The Materials must not contain brand names or trademarks other than those   owned by MSLO or those which entrant has a limited license to use to incorporate in his/her Materials;

The Materials must not contain content which is unlawful, threatening, abusive, harassing, defamatory, libelous, derogatory, degrading, invasive of privacy or publicity rights, fraudulent or tortuous, vulgar, obscene, bigoted or hateful, intimidating, profane, scandalous, pornographic, lewd, indecent or otherwise objectionable;

The Materials must not contain content that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;

The Materials must not contain content that is unlawful, in violation of or contrary to any local, state of federal laws or regulations;

The Materials must not contain content that solicits, encourages, or promotes the use of illegal substances or activities;

The Materials must not contain content that is protected by copyright, trademark, trade secret or any other proprietary right; and

The Materials must not contain content that gives rise to civil or criminal liability, encourages conduct that constitutes a criminal offense or otherwise violates any local, state, or federal law.
